Terms of Trade
These terms of trade apply to quotes, orders and work provided by Aston Rural Enterprises ("we", "us", "our") for the supply, fabrication and installation of gates, fencing and gate automation. By accepting a quote or asking us to proceed with work, you agree to these terms. They do not exclude or limit any rights you have under the Australian Consumer Law (ACL).
Quotes
- Quotes are free and are valid for 30 days from the date we give them, unless we state otherwise.
- A quote is based on the information, measurements and site details you give us. If actual site conditions, sizes or your requirements differ, the price and timeframe may need to change. We will let you know before doing extra work.
- Unless clearly stated, a quote does not include works by others (for example electrical mains supply, earthworks, concreting or removal of existing structures).
Orders, deposits and payment
- Our gates and fences are custom made to order. For bespoke work we ask for a deposit before we order materials or begin fabrication, with the balance due on completion or before delivery or installation, unless we agree otherwise in writing.
- Because materials are bought and items are built specifically for you, a deposit may not be refundable once materials have been ordered or fabrication has started, to the extent permitted by law (see "Your consumer rights" below).
- Please pay invoices by the date shown on them. We may hold delivery or installation until payment has cleared.
Made-to-order work and changes
Custom items are built to the specifications agreed with you, so change-of-mind returns or cancellations do not apply once work has begun. If you need to change a design after fabrication has started, please talk to us, as changes may affect the price and timeframe. Handmade timber and steel products naturally vary in grain, finish and minor dimensions.
Delivery and installation
- Any dates or timeframes we give are estimates made in good faith and are not guaranteed, as they can be affected by weather, materials and site access.
- You are responsible for providing safe and clear access to the site, and for giving us correct information about boundaries and the location of any underground services before we dig or install.
- Risk in the goods passes to you on delivery or installation.
Retention of title
All goods we supply remain our property until you have paid for them in full. Until then, you agree to keep them safe and not to alter or dispose of them.
Your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures you are entitled to a replacement or refund, and to compensation for other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they are not of acceptable quality and the failure does not amount to a major failure. Nothing in these terms limits those rights.
In addition, we stand behind our workmanship and will address genuine faults in materials or workmanship that are reported to us within a reasonable time. This does not cover fair wear and tear, weathering of natural timber, misuse, accidental damage, or work altered or serviced by others.
Liability
To the extent permitted by law, and other than for the consumer guarantees described above, our liability for any claim connected with our goods or services is limited to repairing or replacing the goods, or resupplying the services (or paying the cost of doing so).
Governing law
These terms are governed by the laws of South Australia, and any dispute will be dealt with in the courts of South Australia.
